1. Introduction
These Terms of Service govern your use of the website https://ltconstructionco.online and any construction and building services provided by LT Construction Co Pty Ltd (ABN 90 703 363 222) (“we”, “us”, “our”). By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please discontinue use of the website and do not engage our services.
2. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable law in Victoria that cannot be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees that services will be rendered with due care and skill and will be reasonably fit for purpose.
3. Quotes and Engagement
All quotations provided by LT Construction Co Pty Ltd are valid for the period stated in the quote or, where no period is stated, for 30 days from the date of issue. A binding agreement for services is formed only when we accept your written acceptance of a quote or issue a signed contract. Quoted prices are exclusive of GST unless otherwise stated and may be adjusted where variations to the scope of works are requested or unforeseen site conditions are encountered.
4. Variations to Scope of Works
Any changes to the agreed scope of works must be documented in writing and agreed by both parties before the variation work commences. Additional costs arising from variations will be set out in a written variation order. We will not proceed with variation work without your written approval except where urgent safety works are required.
5. Payment Terms
Invoices are payable in accordance with the payment schedule set out in your contract or quote. Progress payments may be required at defined stages of the works. Overdue amounts may attract interest and reasonable recovery costs. You must not withhold payment except as permitted under the Building and Construction Industry Security of Payment Act 2002 (Vic) or other applicable law.
6. Site Access and Conditions
You agree to provide safe and reasonable access to the worksite at agreed times, ensure the site complies with applicable occupational health and safety requirements, and disclose any known hazards, easements or restrictions affecting the site. Delays caused by lack of access or unsafe site conditions may affect the project timeline and cost.
7. Warranties and Liability
Subject to the Australian Consumer Law, we warrant that our work will be performed with due care and skill and that materials supplied will be of acceptable quality. Our statutory warranty obligations under the Domestic Building Contracts Act 1995 (Vic) apply to domestic building work where relevant. To the fullest extent permitted by law, our liability for any loss or damage arising from the services is limited to the value of the services supplied, except where liability cannot lawfully be limited.
8. Permits and Approvals
Unless otherwise agreed in writing, responsibility for obtaining planning permits, building permits and other statutory approvals will be allocated in the contract. We will advise you of the permits reasonably required for your project and will act in accordance with all applicable Victorian building regulations and the National Construction Code.
